1. A. Pursuant to Utah Code Subsection 34A-5-107(14), the Division may release information gained through its investigations or proceedings to a party to facilitate their participation in the investigation under the following circumstances:

   1. 1. The request is made in writing.
   2. 2. The Division has not received a request from the person or entity providing the information that such information be considered confidential.
   3. 3. The release of the information will not, in the determination of the Division impede the investigation; and
   4. 4. The Division has not determined the requested information should remain confidential or otherwise be protected.
2. B. If a person or entity requests in writing the information provided to the Commission be kept confidential, the Division will consider the reasons underlying the request and make a decision regarding the confidentiality of the information. This determination will govern the release of such information.
3. C. After the conclusion of the investigation, either party may request a copy of investigation file.

4. D. The Division generally will not release the following information:

   1. 1. work product;
   2. 2. personal contact information of any individual;
   3. 3. Social Security information;
   4. 4. bank account numbers; and
   5. 5. medical records, including the ADA questionnaire, unless an appropriate release of medical information is obtained.
5. E. The Division may charge for the costs of providing copies to the parties.
