1. (1) The purpose of this rule is to establish the method and timing for the defrayal of the cost of a state-required benefit enacted on or after January 1, 2012, that is subject to 45 CFR 155.170 of PPACA.

2. (2) This rule applies to a health benefit plan that:

   1. (a) is a qualified health plan;
   2. (b) is offered on the exchange in the individual or small group market;
   3. (c) has an effective date of coverage on or after January 1, 2020; and
   4. (d) offers a state-required benefit in excess of the Utah Essential Health Benefits Package.
