1. (1)(a) An insurer filing a Medicare supplement filing shall comply with:

   1. (i) Section 31A-22-620;

      1. (ii) Rule R590-85; and
      2. (iii) Rule R590-146.
   2. (b) A Medicare supplement form filing that affects rates shall include all required rating documentation.

2. (2) Rates.

   1. (a) Rate and rate documentation submitted with a new form filing are a file and use filing.
   2. (b) A rate revision filing is a file for acceptance filing.

   3. (c) An insurer filing a Medicare supplement rate shall comply with:

      1. (i) Section 31A-22-602;
      2. (ii) Rule R590-85; and
      3. (iii) Rule R590-146.
   4. (d) An insurer may not use or change a premium rate for a Medicare supplement policy or certificate unless the rate, rating schedule, and supporting documentation are filed.
   5. (e) A rate revision request may not be used to satisfy the annual filing requirements of Rule R590-146.
