1. (1) the variance is based on scientifically sound information and rationale;
2. (2) the variance will cause no significant threat to other public or private aquaculture operations, or to public fishery resources; or
3. (3) the variance is approved by majority vote of a quorum of the Board.

Circumstances may arise that cannot be adequately addressed or resolved with this rule. The Board may grant specific variances to the rule if the following conditions are met:
