- (1) "Average nightly count" means the average number of youths enrolled at midnight in a program for a specified time period.
- (2) "Lapsing funds" means funds unspent during a fiscal year that are not designated as non-lapsing.
(3) "Out-of-home placements" means division programs consisting of:
- (a) "Community-based program" as defined in Subsection 80-1-102(16);
- (b) "Detention" as defined in Subsection 80-1-102(23); and
- (c) "Secure care" as defined in Subsection 80-1-102(73).
