- (1) The Department of Health and Human Services may create rules necessary for social services pursuant to Section 26B-1-202. The Office of Recovery Services (ORS) may adopt, amend, and enforce rules pursuant to Section 26B-9-108.
- (2) The purpose of this rule is to establish how ORS determines the appropriate emancipation date for IV-D child support cases, particularly when determining the child's normal and expected year of graduation referenced in Section 81-6-213 for child support orders issued on or after July 1, 1994. This rule also clarifies a child's age of majority as described in Section 78B-5-202 to be used when ORS determines the duration of a judgment for past due support.
