(1) The regional adoption assistance committee shall end an adoption assistance agreement for a monthly subsidy or state medical assistance if any of the following occur:
- (a) the terms of the adoption assistance agreement are concluded;
- (b) the adoptive parents request ending the monthly subsidy;
- (c) the month following a child's 18th birthday, unless approval has been given by the adoption assistance committee to continue until the month following a child's 21st birthday due to mental or physical disability;
- (d) a child dies;
- (e) the adoptive parents die;
- (f) the adoptive parents' legal responsibility for a child ceases;
- (g) the state determines that a child is no longer receiving financial support from the adoptive parents;
(h) a child enters the military; or
- (i) a child marries.
- (2) Ending state medical assistance is subject to the policies of the Department of Health and Human Services.
(3) Supplemental adoption assistance shall end when:
- (a) an adoption assistance agreement for a monthly subsidy or state medical assistance is ended;
- (b) the terms of the agreement are concluded;
- (c) the authorizing committee determines that the services funded with supplemental funds are no longer effective or appropriate based upon an independent review by a qualified provider; or
- (d) if lack of availability of state funding prevents continuation.
- (4) The regional adoption assistance committee shall provide written notice as described in Section R512-43-5 to the adoptive family at least 30 days before funding is discontinued due to lack of availability of state funding appropriated for adoption assistance or due to determination that services are no longer effective or appropriate.
