1. (1) This section does not apply to a child-placing foster care agency or foster homes certified under their license, unless the agency maintains a department contract for placement of DCFS foster children.

2. (2) The foster parent may use a short-term relief provider if:

   1. (a) DCFS approves the immediate family member or relative of the foster parent in-writing for caring for the foster child for less than six consecutive nights;
   2. (b) the immediate family member or relative of the foster parent has an eligible OBP background check; and
   3. (c) the immediate family member or relative of the foster parent, is not a relative of the foster child, unless approved by DCFS for a licensed kinship foster parent or an individual identified for preserving connection.
