1. (1) The licensee shall:

   1. (a) assume responsibility for the overall organization, management, operation, and control of the facility;
   2. (b) ensure compliance with each federal, state, and local law;
   3. (c) establish policies and procedures for resident welfare, protection of resident rights, and the general operation of the facility; and
   4. (d) implement and follow a policy that ensures the licensee may not discriminate on the basis of race, color, sex, or religion.

2. (2)(a) The licensee shall implement a quality assurance program to include a quality assurance committee.

   1. (b) The quality assurance committee shall:

      1. (i) consist of at least the administrator and a health care professional; and
      2. (ii) meet at least quarterly to identify and act on quality issues.
3. (3) If the licensee is a corporation or an association, it shall maintain an active and functioning governing body to fulfill licensee duties and to ensure accountability.
