(1) If the parent or legal guardian of an eligible child enrolls their child in a Baby Watch EI Program and receives fee eligible services the parent or legal guardian shall pay a family fee. The family fee applies for any month in which at least one billable service is:
- (a) provided to the child; or
- (b) not canceled by the family by 9 a.m. the morning of the scheduled service.
- (2) The EI program shall charge the family based on a sliding fee schedule established by the department annually. The sliding fee schedule shall begin at 185% of the most recently published federal poverty guidelines.
- (3) The maximum family fee on the sliding fee schedule shall be $200 per month.
(4) The EI program may not charge the family fee if the child or the child's family receives benefits under any of the following programs:
- (a) Medicaid;
- (b) Temporary Assistance to Needy Families;
- (c) Family Employment Plan - Cash Assistance;
- (d) Women Infants and Young Children;
- (e) Early Head Start based on income;
- (f) Child is a ward of the state;
- (g) Primary Care Network; or
- (h) Children's Health Insurance Program.
