1. (1) "Advisory panel" means a panel of experts serving in an advisory capacity to the department for the allocation of scarce health care resources.

2. (2) "Emergency circumstance" means a situation that poses an imminent threat to the life, health, or safety of citizens including one or more of the following:

   1. (a) treatment is no longer efficacious;
   2. (b) chemical, biological, radiological and nuclear agents;
   3. (c) terrorist attack; or
   4. (d) a catastrophic natural disaster.
3. (3) "Public health emergency" means the same as defined in Subsection 26-23b-102(9).
4. (4) "Health care resource" means the same as defined in Section 26B-1-219.
5. (5) "Rationing criteria" means the same as defined in Section 26B-1-219.
6. (6) "Scarce health care resource" means the same as defined in Section 26B-1-219.

The definitions found in Section 26B-1-219 apply to this rule. In addition, the following definitions apply:
