1. (1) during the pendency of a timely:

   1. (a) protest under Section R354-9-103;
   2. (b) appeal of a protest under Section R354-10-103; or
   3. (c) appeal of a Procurement Appeals Panel decision under Section R354-11-102; and

2. (2) until:

   1. (a) Each administrative and judicial remedies are exhausted; or
   2. (b) for a protest under Section R354-9-103, an appeal under Section R354-10-103, an appeal under Section R354-11-102, or an appeal to a higher court than district court the Procurement Officer, after consultation with the attorney general's office, or approved outside counsel, and the CRAU Chair, makes a written determination that award of the Contract without delay is in the best interest of the CRAU.
