1. (1) When the state makes a payment from the Petroleum Storage Tank Fund, the state has the right to sue or take other action as may be necessary and appropriate to recover the amount of payment from any third party who may be held responsible.

   1. (a) the claimant who receives payment from the Fund must execute and deliver the necessary documents and cooperate as necessary to preserve the state's rights and do nothing to prejudice them.
