1. (1) Owners and operators not participating in the EAP must, before any subsequent participation in the EAP, meet the following requirements:

   1. (a) notify the director of the intent to participate in the EAP;
   2. (b) comply with the requirements of Subsection 19-6-428(2); and
   3. (c) meet the requirements of Section R311-206-3 to qualify for a new certificate of compliance.
