1. (1) Dispenses gasoline or diesel fuel into the fuel tank of a motor vehicle, motor vehicle engine, nonroad vehicle, nonroad engine, or emergency engine.
2. (2) Is not located at a major source.
3. (3) Complies with the applicable requirements of 40 CFR 63 Subpart CCCCCC if the fuel storage tank contains gasoline.

An owner or operator of a fuel storage tank that meets the requirements of Subsections R307-431-9(1), (2), and (3) is not required to obtain an Approval Order under Section R307-401-8 if the fuel storage tank:
