- (1) The emergency engine is not located at a major source.
- (2) The emergency engine does not operate more than 100 hours per calendar year for non-emergency situations, which includes maintenance checks and readiness testing. There is no time limit on the use of emergency engines in emergency situations.
- (3) The emergency engine is not located at a source with a combined site emergency engine rating greater than 3,200 horsepower.
- (4) Any emergency engine rated more than 750 horsepower is not operated for maintenance and testing purposes at the same time as any other emergency engine.
- (5) Each emergency engine installed after the effective date of this rule shall have a manufacturer date of January 1, 2009, or later.
- (6) The owner or operator of an emergency engine shall keep records of the emergency engine's operation in accordance with 40 CFR 63.6655(f).
An owner or operator of an emergency engine that meets the requirements of Subsections R307-431-13(1) through (6) is not required to obtain an Approval Order under Section R307-401-8 if:
