1. (1) Rule R307-315 applies to each boiler that:

   1. (a) is fueled exclusively by natural gas;
   2. (b) has a total rated heat input at least 2.0 MMBtu/hr and not more than 5.0 MMBtu/hr;
   3. (c) is an industrial boiler, institutional boiler, or commercial boiler;
   4. (d) is located in Salt Lake, Utah, Davis, Weber, or Tooele County; and

   5. (e) undergoes one of the following after the compliance date defined in Subsection R307-315-6(4):

      1. (i) installs a boiler;
      2. (ii) replaces an existing boiler;
      3. (iii) replaces the components of a boiler such that the fixed capital cost of the new components exceeds 50% of the fixed capital cost that would be required to construct a comparable new boiler;
      4. (iv) replaces a burner in a boiler having only a single burner; or
      5. (v) replaces 50% or more of the burners in a multi-burner boiler.

2. (2) Exemptions to this rule include:

   1. (a) residential boilers as defined in this rule;
   2. (b) CO boilers as defined in this rule;
   3. (c) waste heat boilers as defined by this rule;
   4. (d) process heaters as defined by this rule; and
   5. (e) temporary boilers as defined by this rule.
