1. (1) The Superintendent shall:

   1. (a) conduct LEA program administrative reviews, such as Utah Program Improvement Planning System or "UPIPS" monitoring;
   2. (b) require student attendance and membership accountability;
   3. (c) provide technical assistance to LEAs;

   4. (d) collect data on:

      1. (i) the number, disabilities, and levels of students served;
      2. (ii) the types of program delivery models used;
      3. (iii) costs of the ESY services in LEAs; and
      4. (iv) program effectiveness.
   5. (e) develop guidelines for LEAs.

2. (2) An LEA shall:

   1. (a) establish LEA procedures which are in accordance with Board rules;
   2. (b) provide professional learning and on-site visits to assure that Board and LEA procedures are appropriately understood and implemented;
   3. (c) establish timelines to accomplish the purposes of this rule;
   4. (d) analyze LEA needs, reported by professionals, for ESY services for individual, eligible students;

   5. (e) determine LEA ESY services parameters based upon data received from educators on individual, eligible students, including:

      1. (i) the personnel required to provide special education and related services;
      2. (ii) location of services; and
      3. (iii) budget specifications;
   6. (f) ensure parents, adult students, and professionals have received information about dispute resolution procedures for the appeal of ESY eligibility decisions and ESY services parameters; and
   7. (g) implement processes to collect program effectiveness data.
