1. (1) The Board may designate up to 2% of the total legislative appropriation for oversight, monitoring, and evaluation of adult education programs.

2. (2) The Superintendent may recommend that the Board withhold state or federal funds in accordance with Rule R277-114 for noncompliance with:

   1. (a) Board rule;
   2. (b) adult education state policy and procedures;
   3. (c) associated reporting timelines; and

   4. (d) program monitoring outcomes, as defined by the Board, including:

      1. (i) lack of program improvement; and
      2. (ii) unsuccessful student outcomes.
