1. (1) This rule is authorized by:

   1. (a) Utah Constitution Article X, Section 3, which vests general control and supervision over public education in the Board;
   2. (b) Subsection 53E-3-401(4), which allows the Board to make rules to execute the Board's duties and responsibilities under the Utah Constitution and state law; and
   3. (c) Section 53E-10-309, which requires the Board to make rules to establish the requirements for the Utah PRIME Program.

2. (2) The purpose of this rule is to:

   1. (a) establish eligibility requirements for a participating LEA; and
   2. (b) create an application process for LEAs to apply for the program.
3. (3) This Rule R277-406 is categorized as Category 4 as described in Rule R277-111.
