1. (1) This rule is authorized by:

   1. (a) Utah Constitution Article X, Section 3, which vests general control and supervision over public education in the Board;
   2. (b) Subsection 53E-3-401(4), which allows the Board to make rules to execute the Board's duties and responsibilities under the Utah Constitution and state law; and
   3. (c) Subsection 53G-6-503(2), which directs the Board to make rules for a student transferring between a charter school and the student's boundary school within the student's district of residence and enrolling and withdrawing from charter schools.

2. (2) The purpose of this rule is to:

   1. (a) provide procedures for a student transferring between a charter school and the student's boundary school within the student's district of residence;
   2. (b) define capacity in district schools to allow for transfers into district schools from charter schools; and
   3. (c) require LEAs to provide notice to parents and students of schools that have space available.
