1. (1) This rule is authorized by:

   1. (a) Utah Constitution Article X, Section 3, which vests general control and supervision over public education in the Board;
   2. (b) Subsection 53E-3-401(4), which allows the Board to make rules to execute the Board's duties and responsibilities under the Utah Constitution and state law;
   3. (c) Section 53F-10-102, which requires the Board to make rules to establish a process for school districts to submit proposals for funding for capital development projects under Title 53F, Chapter 10, State Funding - Capital Projects; and
   4. (d) Subsection 53F-10-303(3), which requires the Board to make rules for distribution of the Rural School Sports Facilities Grant.

2. (2) The purpose of this rule is to establish a process for school districts to submit proposals for funding for capital development projects, including:

   1. (a) review, prioritization, and recommendations to the Board;
   2. (b) the Board's consideration and approval, if applicable, of proposed capital development projects; and
   3. (c) management of Capital Projects Evaluation Panel processes and administration.
3. (3) This rule is categorized as Category 3 as described in Rule R277-111.
