1. (1) A hearing is permitted in an informal adjudicative proceeding if:

   1. (a) the entity in a properly filed request for hearing or in the course of participation raises a genuine issue as to a material fact as provided in Section R21-2-10; and
   2. (b) participates in an office conference.
