1. (1) The following persons or entities are eligible for participation in the public safety radio:

   1. (a) a state agency;
   2. (b) a public safety agency; and
   3. (c) a public safety answering point;

2. (2) The following persons or entities are eligible for participation in the public safety radio network pursuant to an application approved by the Executive Director:

   1. (a) a political subdivision of the state or agency thereof that is:

      1. (i) not a public safety agency or public safety answering point;
      2. (ii) sponsored by a public safety agency; and
      3. (iii) approved to participate for a specified public safety purpose; or
   2. (b) any other person or entity with the express approval of the Executive Director.
