1. (1) Project registration renewal. To renew a registration of a project, a person shall submit to the division, no later than the expiration date set forth on the order of registration:

   1. (a) an annual report;

   2. (b)(i) an updated property report, with changes underlined in red; or

      1. (ii) a statement that no changes have occurred in the property report that is on record with the division;
   3. (c) a description of any change in the information provided in the application for registration;

   4. (d) documentation of any judicial proceeding or regulatory investigation instituted by complaint of a purchaser against the developer and arising out of or relating to:

      1. (i) the advertising or sale of an interest;
      2. (ii) disclosures required under Section 57-19-11;
      3. (iii) rescission rights;
      4. (iv) fraud; or
      5. (v) misrepresentation of interests represented by the registration; and
   5. (e) a nonrefundable renewal fee.

2. (2) Reinstatement.

   1. (a) To reinstate an expired project registration, a person shall submit to the division, no later than 90 calendar days following the expiration of the registration:

      1. (i) all materials required for a timely renewal; and
      2. (ii) a nonrefundable late fee.
   2. (b) A registration that is expired more than 90 days may not be renewed or reinstated. To obtain a registration, a person shall apply as a new applicant.
