1. (1) The commission may not convert a revocation that was based on a felony conviction involving fraud, misrepresentation, deceit or dishonesty, breach of trust, or money laundering.

2. (2) The commission may consider converting a revocation that was based on other criminal history, including:

   1. (a) a plea in abeyance, diversion agreement, or similar disposition of a felony charge; and
   2. (b) a misdemeanor offense, regardless of the nature of the charge or the disposition of the case.

In reviewing a request to convert a revocation to a suspension pursuant to Section 61-2c-402(4)(a):
