1. (1) Under Subsection 58-60-102(4), to be eligible to become a Division-approved clinical supervisor and oversee the clinical supervision of a master's level license holder, a licensed individual shall:

   1. (a) be an active license holder in good standing in one of the following classifications:

      1. (i) APRN specializing in the practice of clinical mental health therapy under Subsection R156-31b-302e(2);
      2. (ii) CMHC;
      3. (iii) LCSW;
      4. (iv) MFT;
      5. (v) physician who is board certified or board eligible in psychiatry;
      6. (vi) psychologist; or
      7. (vii) MAC;
   2. (b) hold a master's degree or higher;
   3. (c) be licensed under Subsection (1)(a) for at least two years before providing supervision;
   4. (d) complete a supervisor training program that meets the requirements of Section R156-60e-306.1;

   5. (e) meet one of the following requirements during the 24 months preceding supervision:

      1. (i) have overseen or engaged in direct clinical supervision of another licensed individual;
      2. (ii) provided clinical mental health therapy; or
      3. (iii) provided direct client care; and
   6. (f) submit proof to the Division that the licensed individual has completed the training program under Subsection (1)(e) and request Division-approved status as a clinical supervisor.
2. (2) A qualified mental health training supervisor shall comply with the duties and responsibilities established in Sections R156-60e-307.1 and R156-60e-308.1.

3. (3) A clinical supervisor may not supervise an individual:

   1. (a) who employs or supervises the clinical supervisor;
   2. (b) who is a family member; or

   3. (c) if the supervision is compromised by a relationship where the supervisor is controlled by:

      1. (i) the supervised individual; or
      2. (ii) the supervised individual's employing agency, if the if the supervised individual has ownership in the employing agency.
