1. (1) Under Subsection 58-55-302(2)(b), an applicant for licensure shall file with the Division proof of liability insurance and workers compensation insurance described in this section.

   1. (i) liability insurance in force that includes:

      1. (A) the policy number, the expiration date of the policy, the insurance company name and contact information, and coverage amounts of at least $1,000,000 for each incident and $3,000,000 in total;
      2. (B) the Division named as a certificate holder;
      3. (C) that provides coverage for the scope of work performed;
      4. (D) that is in force for the entire duration of licensure.

      5. (ii) either:

         1. (A) workers' compensation insurance in force that names the Division as a certificate holder, includes the policy number, the expiration date of the policy, the insurance company name and contact information; or
         2. (B) an affidavit that the applicant does not hire employees and is therefore exempt from the requirement to have workers' compensation insurance as evidenced by a valid Workers' Compensation Coverage Waiver issued by the Utah Labor Commission.
2. (2) A Licensee shall update the Division immediately regarding any materials changes to the policies listed in Subsection R156-55a-302d(1) during the licensing period.
