1. (1)(a) The department may order or permit the parties to file memoranda to assist in conducting agency review.

   1. (b) Memoranda shall comply with:

      1. (i) this rule; and
      2. (ii) a scheduling order entered by the department.

2. (2)(a) If a transcript is not necessary to conduct agency review, a memorandum supporting a request for agency review shall be concurrently filed with the request.

   1. (b) If a transcript is necessary to conduct agency review, a party requesting agency review shall file a supporting memorandum no later than 15 days after the filing of the transcript with the department.

3. (3)(a) A response to a request for agency review and a memorandum supporting that response shall be filed no later than 30 days after the service of the memoranda supporting the request.

   1. (b) A final reply memorandum shall be filed no later than 10 days after the service of a response to the request for agency review.
4. (4) If agency review involves more than two parties the department shall conduct a telephonic scheduling conference to address briefing deadlines.
