1. (1) the discovery sought is unreasonably cumulative, duplicative, or is obtainable from some other source that is:

   1. (a) more convenient;
   2. (b) less burdensome; or
   3. (c) less expensive;
2. (2) the party seeking discovery has had ample opportunity by discovery in the action to obtain the information sought; or

3. (3) the discovery is burdensome or expensive, taking into account:

   1. (a) the needs of the case;
   2. (b) the amount in controversy;
   3. (c) the limitations on the parties' resources; and
   4. (d) the importance of the issues at stake in the litigation.

The presiding officer shall limit the frequency and extent of discovery regardless of whether either party files a motion to limit discovery if:
