This subchapter describes the procedures for the department's director of the Motor Carrier Division (Motor Carrier Division Director) to review and issue a final order in a contested case in which the following conditions are met:

1. (1) the Motor Carrier Division Director is the final order authority pursuant to a delegation under this chapter or as designated under Transportation Code, §643.001(2); and
2. (2) a SOAH ALJ has submitted a final proposal for decision for consideration by a person with such final order authority.
