1. (a) Pursuant to Texas Occupations Code, Chapter 53, Subchapter D, a person may request that the department evaluate the person's eligibility for a specific occupational license regulated by the department by:

   1. (1) submitting a request on a form approved by the department for that purpose; and
   2. (2) paying the required Criminal History Evaluation Letter fee of $100.
2. (b) The department shall respond to the request not later than the 90th day after the date the request is received.
