1. (a) An applicant may send to the department a written response to an application denial within 15 working days after the date that the department sends notice of denial under §9.308 of this subchapter (relating to Certification Decision).
2. (b) If the applicant does not send a written response within the 15-day period, the denial of certification is final.

3. (c) If an applicant responds within the period provided under subsection (a) of this section, the department will:

   1. (1) certify the applicant if the response resolves the eligibility deficiencies; or
   2. (2) deny the application if the response does not resolve the eligibility deficiencies.
