1. (a) Access purchase request. A request to purchase a new access connection to a highway across an access denial line will be considered under this section. The request must include an engineering study acceptable to the department.
2. (b) Determination. The commission will make the final determination concerning the sale of access rights under this section. The commission may consider the findings of the engineering study, the mobility and safety of the highway system, and any other relevant factors.
3. (c) Sale procedure. A sale of access rights under this section is subject to Transportation Code, Chapter 202, Subchapter B. Access points approved by the commission under this section will be specifically described by a metes and bounds property description.
