1. (a) The Commission may, on its own motion:

   1. (1) affirm, modify, or set aside a decision issued under §844.85 of this subchapter on the basis of the evidence previously submitted in the case; or
   2. (2) direct the taking of additional evidence.
2. (b) The Commission may permit the parties to initiate a further appeal before the Commission.
