Right to a Hearing

- (a) A hearing must be granted to any alleged perpetrator about whom a finding of child abuse or neglect or adult abuse, neglect, or exploitation is to be released without that individual's consent.
- (b) A hearing must also be granted to any alleged perpetrator against whom an adverse action is to be taken by the department.
- (c) If an alleged perpetrator is entitled to hearings under both subsections (a) and (b) of this section, the department may combine the two hearings in a single proceeding.
