This subchapter applies only to:

1. (1) an investigation of abuse or neglect relating to a child fatality, other than a school investigation, that is conducted by the department's Child Protective Services division; and

2. (2) an investigation of abuse or neglect relating to a child fatality that is conducted by the department's Child Care Licensing division in which the child-care provider that is investigated for possible abuse or neglect is one of the following types of residential care providers regulated under Chapter 42, Human Resources Code:

   1. (A) an agency foster home or agency foster group home;
   2. (B) an independent foster home or independent foster group home; or
   3. (C) a general residential operation.
