An individual that is not employed by a local governmental entity is subject to all rules and regulations of the commission pertaining to fire protection personnel if the individual would be a fire protection personnel if the person was employed by a local governmental entity and:

1. (1) provides fire protection to a local governmental entity under a contract or other agreement between the individual and the local governmental entity; or
2. (2) provides fire protection to a local governmental entity under a contract or other agreement between a governmental entity and a nongovernmental organization regulated under §495.201 of this title (relating to Nongovernmental Organizations).
