1. (a) Purpose. The purpose of this subchapter is to:

   1. (1) establish guidelines by which a product is eligible to be considered a recycled product;
   2. (2) identify what is not eligible to be considered a recycled product; and

   3. (3) identify third-party certification systems for mass balance attribution to certify:

      1. (A) "Recycled material";
      2. (B) "Recycled plastics"; and
      3. (C) the portion of the total content of a product that consists of recycled material.
2. (b) Applicability. This subchapter is applicable to determining that a product is eligible to be considered a recycled product and third-party certification systems for mass balance attribution.
