The following appendices contained in 40 Code of Federal Regulations, Part 122, which are in effect as of the date of Texas pollutant discharge elimination system (TPDES) program authorization, as amended, are adopted by reference and apply only to TPDES permits:

1. (1) Appendix A--NPDES Primary Industry Categories;
2. (2) Appendix B--Criteria for Determining a Concentrated Animal Feeding Operation;
3. (3) Appendix C--Criteria for Determining a Concentrated Aquatic Animal Production Facility;
4. (4) Appendix D--NPDES Permit Application Testing Requirements.
