This chapter only applies to a merger agreement among hospitals, each of which is located within a county that:

1. (1) contains two or more hospitals; and

2. (2) has a population of:

   1. (A) less than 100,000 and is not adjacent to a county with a population of 250,000 or more; or
   2. (B) more than 100,000 and less than 150,000 and is not adjacent to a county with a population of 100,000 or more.
