The provisions of this subchapter shall apply to each of the following in which mental health services are provided:

1. (1) facilities of the Texas Department of Mental Health and Mental Retardation and their respective community-based programs;
2. (2) community centers;
3. (3) psychiatric hospitals; and
4. (4) any program contracting with these entities.
