1. (a) A case manager must not provide MH case management services to an individual if a dual relationship exists.
2. (b) Activities that do not constitute MH case management services are identified in the department's MH Case Management Billing Guidelines as referenced in §412.416 of this title (relating to Guidelines).
3. (c) The provider must ensure that a conflict of interest does not exist if the same case manager is providing other, non-case management services.
4. (d) The provider must ensure that providers of case management services cannot authorize services.
5. (e) The receipt of MH case management services cannot be conditioned upon receipt of other services.
