An individual is entitled to a fair hearing in accordance with 1 TAC Chapter 357, Subchapter A (relating to Uniform Fair Hearing Rules), if:

1. (1) the individual's request for enrollment into the CLASS Program is denied or is not acted upon with reasonable promptness; or
2. (2) the individual's CLASS Program services or CFC services have been denied, suspended, reduced, or terminated by HHSC.
