1. (a) Authority. This chapter is adopted under the authority of Texas Occupations Code, Chapters 51 and 801.
2. (b) Applicability. This chapter prescribes procedural rules during the department's temporary administration of the board.

3. (c) Conflicts. In the event of a conflict between this chapter, the rules of the board under 22 TAC Chapter 575, and the rules of the department under 16 TAC, Chapter 60:

   1. (1) This chapter prevails over any conflicting provision in Chapter 575 or Chapter 60;
   2. (2) Unless otherwise specified in law, where there is no applicable provision in this chapter, the provisions of Chapter 575 prevail over a conflicting provision of Chapter 60; and
   3. (3) Where there is no applicable provision in either this chapter or Chapter 575, the provisions of Chapter 60 prevail.
