1. (a) The amount of the Medicaid Estate Recovery Program (MERP) claim will be calculated as the amount paid under §373.103(c) of this title for the benefit of a Medicaid recipient for covered medical assistance services received after the Medicaid recipient reached 55 years of age.
2. (b) No claim will be filed for services received prior to the effective date of these rules.
3. (c) The claim amount may be amended prior to and after MERP files the recovery claim.
