1. (a) Introduction. This section describes the policies HHSC will follow related to the review of audit findings and recoupment of overpayments in the Texas Medicaid Electronic Health Record (EHR) Incentive Program.
2. (b) Review of audit findings. A review of audit findings is limited to the reviews provided for in §354.1450 of this title (relating to Audits of Medicaid Providers).
3. (c) Recoupment. HHSC will recoup an EHR incentive payment if it was paid in excess of what a Medicaid provider is eligible to receive under the Texas Medicaid EHR Incentive Program, including a payment resulting from HHSC error or a payment that is identified as part of an audit.
