This subchapter does not change a resale or sharing arrangement permitted in an incumbent local exchange company tariff that:

1. (1) existed on September 1, 1995; or
2. (2) was filed on or before May 1, 1995, by an incumbent local exchange company that serves more than five million access lines in this state.
