1. (a) A person commits an offense if the person:

   1. (1) is required to establish financial responsibility under Subchapter F or K;
   2. (2) does not maintain evidence of financial responsibility; and

   3. (3) during the period evidence of financial responsibility must be maintained:

      1. (A) operates on a highway a motor vehicle owned by the person; or
      2. (B) knowingly permits another person, who is not otherwise permitted to operate a vehicle under this chapter, to operate on a highway a motor vehicle owned by the person.

2. (b) An offense under this section is a misdemeanor punishable by:

   1. (1) a fine not to exceed $500;
   2. (2) confinement in county jail for a term not to exceed six months; or
   3. (3) both the fine and the confinement.
