Except to the extent restricted by a trust agreement, a holder of a bond issued under this subchapter and a trustee under a trust agreement may:

1. (1) protect and enforce by a legal proceeding in any court a right under:

   1. (A) this subchapter or another law of this state;
   2. (B) the trust agreement; or
   3. (C) the order authorizing the issuance of the bond; and

2. (2) compel the performance of a duty this subchapter, the trust agreement, or the order requires the commission or the department or an officer of the commission or the department to perform, including the imposing of tolls.
